By using Evergreen ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. Evergreen is operated by the individual creator behind myevergreen.garden ("we," "us," "our").

2. What Evergreen Provides

Evergreen is a subscription service that provides personalized outdoor plant recommendations and weekly garden care emails based on your location, sunlight conditions, and growing goals. Recommendations are generated with the assistance of AI and are intended for informational and planning purposes only. They do not constitute professional horticultural, landscaping, or agricultural advice.

3. Subscription and Billing

Evergreen+ is offered as a monthly subscription at $5.00 USD per month, billed automatically on a recurring basis through Paddle, our payment processor. By subscribing, you authorize Paddle to charge your payment method each billing period until you cancel.

• Your subscription renews automatically each month.
• You may cancel at any time through the Cancel Membership page.
• Cancellation takes effect at the end of your current billing period — you retain full access until then.
• We reserve the right to change pricing with 30 days' notice.

4. Free Tier

Evergreen offers a free tier with limited plant recommendations (up to 3 plants). No payment information is required for the free tier.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, reverse-engineer, or resell content generated by the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use automated systems to access the Service in ways that exceed normal human usage

6. Intellectual Property

All content, branding, and software underlying Evergreen is owned by us. The personalized recommendations we generate for you are yours to use for your own gardening purposes, but may not be resold or redistributed.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. Plant recommendations may not account for all local conditions, soil types, microclimates, pests, or regulations. We are not responsible for outcomes resulting from following our recommendations. Always verify plant suitability with local nurseries or extension services for critical plantings.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated by email.
